1. About these terms

Maintis ("we", "us", or "our") provides a cloud-based Computerized Maintenance Management System ("CMMS") to help organizations manage locations, assets, work requests, work orders, and preventative maintenance (the "Service"). These Terms and Conditions ("Terms") govern your access to and use of the Service. By registering for or using the Service, you agree to these Terms.

2. Changes to these terms

We may update these Terms from time to time to reflect changes in the Service or legal requirements. We will notify you of material changes by email or in-product notice. Continued use of the Service after changes take effect constitutes acceptance.

3. About the Service

Maintis provides tools for: work requests, work orders, preventative maintenance plans, asset management, multi-site location management, contacts, team management with role-based access, reporting, and external sharing. When you register, we create an account for your organization that can be accessed by authorized users (admins, managers, staff, technicians) under your control.

You are responsible for: (a) maintaining accurate account information; (b) managing which users are invited to your account; and (c) ensuring anyone who accesses the Service under your account complies with these Terms.

4. Acceptable use

We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes. You agree not to:

  • Use the Service in violation of applicable laws
  • Reverse engineer or derive source code from the Service
  • Bypass security controls or access restrictions
  • Resell or sublicense the Service to third parties
  • Upload unlawful or harmful content
  • Share login credentials or allow unauthorized access

We may suspend or terminate access if we reasonably believe these Terms are being violated.

5. Subscription & payment

Access is provided on a subscription basis (monthly or annually) at the pricing presented at sign-up. Subscriptions automatically renew unless cancelled. Failure to pay may result in suspension or termination. All fees are non-refundable except as required by law.

6. Data & privacy

You retain ownership of data you submit to the Service. You grant us a limited license to host, process, and display your data as needed to operate the Service. Our Privacy Policy describes how we collect and use personal data.

You are responsible for ensuring you have the necessary rights to submit your data and for complying with applicable data protection laws.

7. Service availability

We aim for reliable availability but do not guarantee the Service will be uninterrupted or error-free. The Service may be temporarily unavailable for maintenance or technical issues. We will provide reasonable notice of planned downtime where possible.

8. Limitation of liability

To the fullest extent permitted by law, Maintis shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total aggregate liability shall not exceed the fees you paid in the 12 months prior to the claim.

9. Termination

You may cancel your subscription at any time from your account settings. We may suspend or terminate access for material breach. Upon termination, your access ceases. We recommend exporting any data you need before cancellation.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which our operating company is established, without regard to conflict of law principles.
